What does this income-tax notice require, and what should I submit?
First identify the notice: an intimation of adjustments after processing (section 143(1)), a scrutiny notice (section 143(2)) with questions under section 142(1), a reassessment notice (sections 148A and 148), or a demand or penalty notice (the Income-tax Act, 1961 for tax years up to 2025-26; the corresponding provisions of the Income-tax Act, 2025 from tax year 2026-27). Check the assessment year, the Document Identification Number, the date of service and the deadline. Then gather what is asked for, reconcile the department’s figures with your return and AIS, and reply on the e-filing portal, asking for an adjournment or a hearing where needed. What the law says — s.148, s.148A and s.149, Income-tax Act 1961

A reassessment begins with a show-cause under s.148A giving the assessee a chance to explain before any notice under s.148 issues. The Assessing Officer must hold information suggesting income has escaped assessment and obtain the specified authority's sanction. The reply stage is where most reassessments are won or lost, because an order under s.148A(3) that ignores the reply is open to writ challenge. The Income-tax Act, 2025 is in force from 1 April 2026 and applies to tax year 2026-27 onward; the section numbers above are those of the 1961 Act, which continues to govern assessments, appeals and pending proceedings for earlier years.

How does the procedure work?

  1. Verify the notice: assessment year, sanction, and whether the s.149 time limit has run
  2. Call for the information relied on and the reasons recorded
  3. File a point-by-point reply under s.148A with documentary support
  4. Where the reply is rejected, decide between filing the return under s.148 and a writ petition
  5. Participate in the reassessment and preserve grounds for appeal under s.246A
Time limitNotice within 3 years from the end of the relevant assessment year; up to 5 years where escaped income is Rs 50 lakh or more (s.149 as amended by the Finance (No. 2) Act, 2024)
FormsReply to s.148A notice on the e-filing portal; return in response to s.148 (ITR with reason code)
Consequence of defaultReassessed income attracts tax, interest under s.234A/B/C and penalty under s.270A (50% for under-reporting, 200% for misreporting)
