Frequently Asked Questions

What is the time limit for filing section 263 revision petition?
Income tax appeals before CIT(A)/NFAC must be filed within 30 days of the assessment order. ITAT appeals within 60 days. Late filing requires condonation with valid reasons. Contact us immediately upon receiving an adverse order — delay reduces options.
What is the fee for section 263 revision petition consultant?
Fees depend on the complexity, disputed amount, and forum. We offer transparent pricing with no hidden charges. Contact us at +91-99622 60333 for a customised quote. Initial consultation and case assessment is free.
Can Virtual Auditor handle section 263 revision petition across India?
Yes. With physical offices in Chennai, Bangalore, and Mumbai, and the ability to appear before NFAC (faceless) and ITAT benches across India, we handle income tax matters nationwide. CA V. Viswanathan (FCA) is authorised to represent assessees before all income tax authorities.
What can be challenged in this order, what evidence helps, and what are the next procedural steps?
You can challenge additions and disallowances, the computation of income and interest, penalties, and procedural defects such as a notice issued out of time, without valid approval, or without a fair hearing. The first appeal against an assessment or penalty order goes to the Commissioner (Appeals) within 30 days of receiving the order, and a further appeal lies to the Income Tax Appellate Tribunal within two months of the appellate order (the Income-tax Act, 1961 for tax years up to 2025-26; the corresponding provisions of the Income-tax Act, 2025 from tax year 2026-27). Evidence that was before the assessing officer is the base; new evidence is admitted only in limited cases, so assemble it early. You can also ask for a stay of the demand while the appeal is pending. We assess the merits, draft the grounds and statement of facts, and represent you.

What the law says — s.263, Income-tax Act 1961

Section 263 lets the Principal Commissioner revise an assessment order that is both erroneous and prejudicial to the revenue. Both conditions must coexist; an order that follows one of two possible views is not erroneous. The reply must show that the Assessing Officer made the enquiry and took a sustainable view. The Income-tax Act, 2025 is in force from 1 April 2026 and applies to tax year 2026-27 onward; the section numbers above are those of the 1961 Act, which continues to govern assessments, appeals and pending proceedings for earlier years.

How does the procedure work?

  1. Examine the show-cause for the specific error alleged
  2. Reconstruct the assessment record showing enquiries made and replies filed
  3. File a reply with the case law on the twin conditions and on Explanation 2
  4. Attend the hearing; seek a speaking order
  5. Appeal the s.263 order to the ITAT within 60 days if adverse
Time limitRevision order within 2 years from the end of the financial year in which the order sought to be revised was passed
FormsReply on the e-filing portal; Form 36 for the ITAT appeal
Consequence of defaultA fresh assessment follows the revision, with the usual tax, interest and penalty exposure
