Check whether the notice and order state which limb, and which kind of misreporting, is alleged, and whether your case falls within the exclusions in sub-section (6), such as an explanation offered in good faith with all material facts disclosed. What the law says — s.270A and s.270AA, Income-tax Act 1961

Penalty under s.270A is 50% of the tax on under-reported income and 200% where the under-reporting is treated as misreporting. The defence turns on showing the addition falls within the exclusions in s.270A(6), that the explanation was bona fide and disclosed, or that immunity under s.270AA applies where tax and interest were paid and no appeal filed. The Income-tax Act, 2025 is in force from 1 April 2026 and applies to tax year 2026-27 onward; the section numbers above are those of the 1961 Act, which continues to govern assessments, appeals and pending proceedings for earlier years.

How does the procedure work?

  1. Check whether the assessment order recorded a valid initiation of penalty
  2. Evaluate immunity under s.270AA (application within one month of the order)
  3. Prepare the reply mapping each addition to the s.270A(6) exclusions
  4. Respond to the show-cause and seek adjournment where the quantum appeal is pending
  5. Appeal the penalty order to CIT(A) within 30 days
Time limitPenalty order within the limit in s.275 (generally the end of the financial year in which proceedings are completed, or six months from the end of the month in which the penalty is initiated, whichever is later)
FormsForm 68 for immunity under s.270AA; Form 35 for appeal
Consequence of default50% of tax on under-reported income; 200% for misreporting
