Frequently Asked Questions

What is the time limit for filing section 40(a)(ia) disallowance appeal?
Income tax appeals before CIT(A)/NFAC must be filed within 30 days of the assessment order. ITAT appeals within 60 days. Late filing requires condonation with valid reasons. Contact us immediately upon receiving an adverse order — delay reduces options.
What is the fee for section 40(a)(ia) disallowance appeal?

Can Virtual Auditor handle section 40(a)(ia) disallowance appeal across India?
Yes. With physical offices in Chennai, Bangalore, and Mumbai, and the ability to appear before NFAC (faceless) and ITAT benches across India, we handle income tax matters nationwide. CA V. Viswanathan (FCA) is authorised to represent assessees before all income tax authorities.
What can be challenged in this order, what evidence helps, and what are the next procedural steps?
You can challenge additions and disallowances, the computation of income and interest, penalties, and procedural defects such as a notice issued out of time, without valid approval, or without a fair hearing. The first appeal against an assessment or penalty order goes to the Commissioner (Appeals) within 30 days of receiving the order, and a further appeal lies to the Income Tax Appellate Tribunal within two months of the appellate order (the Income-tax Act, 1961 for tax years up to 2025-26; the corresponding provisions of the Income-tax Act, 2025 from tax year 2026-27). Evidence that was before the assessing officer is the base; new evidence is admitted only in limited cases, so assemble it early. You can also ask for a stay of the demand while the appeal is pending. We assess the merits, draft the grounds and statement of facts, and represent you.

Where tax deductible at source on a payment to a resident is not deducted, or is deducted but not deposited by the due date under s.139(1), 30% of the expenditure is disallowed. The disallowance is reversed in the year the TDS is paid, and no disallowance applies if the payee has included the sum in its return and paid tax (second proviso, with Form 26A). How does the procedure work?

  1. Reconcile the ledger, TDS returns and Form 26AS for the year
  2. Obtain Form 26A certificates from payees who have declared the income
  3. Compute the 30% disallowance only on the amount actually in default
  4. File the reply or appeal with the reconciliation and certificates
  5. Claim the deduction in the year of subsequent deposit
Time limitAppeal to CIT(A) within 30 days of the order; Form 26A can be furnished at the appellate stage
FormsForm 26A (Rule 31ACB); Form 35
